Can you fortify candy in order to make a nutrient content claim?

FDA does not consider it appropriate to fortify certain foods, including candy. If a nutrient is added to a food in order to meet the amount required to make a nutrient content claim, the fortification of that food must comply with FDA's fortification policy. If FDA finds a violation of the fortification policy on a product making a nutrient content claim, they may find the item to be misbranded.
